Terms and Conditions (T&C)

1. Scope

1.1 These Terms and Conditions (T&C) apply to all orders placed by customers via the website www.luka-demir.com (here in after referred to as the “Webshop”).

1.2 For the purposes of these T&C, a customer may be either a consumer or a business, unless an explicit distinction is made between these two categories.

1.3 Any deviating terms and conditions of the customer shall not be recognized unless the seller has expressly agreed to their validity in writing.

3. Conclusion of Contract

3.1 The presentation of products in the Webshop does not constitute a legally binding offer but an invitation for the customer to submit an offer.

3.2 By submitting an order, the customer makes a binding offer to conclude a purchase contract. The purchase contract is formed when the seller accepts this offer, either by sending an order confirmation via email or by dispatching the goods to the customer.

3.3 After submitting the order, the customer receives an automatic order confirmation via email confirming receipt of the order. This confirmation does not yet constitute acceptance of the offer.

3.4 The customer may review and correct all entries at any time before completing the order.

4. Prices and Payment

4.1 All prices in the Webshop are final prices and include the applicable statutory value-added tax.

4.2 Shipping costs are added to the product prices. These are clearly displayed during the order process and depend on the specific order.

4.3 The customer may pay using the payment methods offered, e.g., credit card, PayPal, advance bank transfer, or any other payment methods available at the time of ordering.

4.4 Payment of the purchase price is due immediately upon conclusion of the contract. Should the customer fall into arrears, the seller reserves the right to charge reminder fees.

4.5 The customer is responsible for ensuring that the payment information provided during the order process is correct and complete. Any costs arising from incorrect payment information shall be borne by the customer.

5. Delivery

5.1 Delivery is made to the address specified by the customer unless otherwise agreed.

5.2 Delivery is available worldwide. Delivery times vary depending on the destination country and product availability. The seller will confirm the delivery time after receiving the order.

5.3 The seller endeavors to dispatch the order as quickly as possible. Should delays occur, the customer will be informed in a timely manner.

5.4 Shipping costs are calculated based on the delivery address and displayed to the customer during the order process.

5.5 The customer bears the risk for any damage occurring during transport or due to delivery delays, unless statutory liability applies.

6. Right of Withdrawal

6.1 Right of withdrawal for consumers:
Consumers have the right to withdraw from the contract within 14 days without providing any reason.

6.2 Withdrawal period:
The withdrawal period is 14 days from the day on which the customer or a third party designated by the customer takes possession of the goods.

6.3 Exercising the right of withdrawal:
To exercise the right of withdrawal, the customer must inform the seller of the decision to withdraw from the contract by means of a clear statement (e.g., via email to luka.demir@gmx.de).

6.4 Consequences of withdrawal:
In the event of withdrawal, the seller will refund all payments received, including delivery costs (except for additional costs arising from a shipping method chosen by the customer that differs from the standard one).
The customer bears the direct costs of returning the goods. The seller may withhold the refund until the goods have been received or the customer has provided proof of return.

7. Retention of Title

7.1 The goods remain the property of the seller until full payment of the purchase price has been made.

8. Liability for Defects and Warranty

8.1 Statutory warranty rights apply. If the customer receives defective goods, they are entitled to subsequent performance in the form of replacement delivery or defect rectification.

8.2 If replacement delivery or defect rectification fails, the customer may reduce the purchase price or withdraw from the contract.

8.3 Liability for defects is limited to the amount of the purchase price, unless caused by intent or gross negligence.

8.4 The seller is not liable for damage caused by improper handling or use of the goods.

9. Liability

9.1 The seller is liable only for damages caused by intentional or grossly negligent breaches of duty. For slight negligence, the seller is liable only for breaches of essential contractual obligations.

9.2 Liability for damages resulting from injury to life, body, or health remains unaffected.

9.3 The seller assumes no liability for damages resulting from improper use of the products.

10. Data Protection

10.1 The processing of personal data complies with applicable data protection laws. Further information can be found in the privacy policy on our website.

10.2 The customer has the right to access, correct, delete, or restrict the processing of their stored data in accordance with applicable data protection laws.

11. Copyright and Use of the Website

11.1 All content on the website, including texts, images, videos, and graphics, is protected by copyright. The customer is not permitted to use, reproduce, or distribute this content without the express written permission of the seller.

12. Applicable Law and Place of Jurisdiction

12.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2 If the customer is a merchant, the court responsible for the seller’s registered office shall have jurisdiction over disputes arising from this contract. For consumers residing within the EU, the jurisdiction is determined by the consumer’s place of residence.

13. Final Provisions

13.1 Should any individual provision of these T&C be invalid, the remaining provisions shall remain unaffected.

13.2 The seller reserves the right to amend these T&C at any time. Changes will be published on the website and apply from the time of publication.
